yep,i just got in an accident!:( check this out, i was in my car (2001 2dr civic) in the school parking lot, and i put the gear in reverse...i barely let go of the gas and BOOM some girl in a oldsmobile hit my right rear bumper. We both get out of the car and she is looking all nervous while i\'m schocked. she asks for my name and phone number and takes off before i can even asks for hers. My bumper is litteraly hanging and cut!!!:mad:
Then i call the police to report an accident and they come and i tell the story. then i call the insurance company and they say its My Fault?!?!?!? even though she left and i\'m still in the F***ing parking SPACE! Im so F***ing pissed right now!
What do u guys think?

the accident itself sounds like mostly your fault. She will be facing other problems since she left the scene.

Yeah but i was still more than halfway in the parking space...she was that close to the cars! i have not even baked up 3ft. i still cant believe its my fault...:(

yea man, its kinda sucky, but I am *almost* positive that it will be shown on paper as your fault since you were backing out and I *think* you are the one that has to yield.

True but i think in virginia its the law that if any car is hit from the back its the other persons fault...maybe not i dont know where i heard that from!

give me the parking lot scenario, b/c I dont see how she could have directly hit you in the rear without out her being a utter moron and not noticing a car in the parking spot.

She didnt hit me directly in the rear, she hit me on the right side of the rear bumper! But i think i realize what happened...but seriously its not just my fault. i backed out not even half way out and she hit me.

it is law (at least here in Ohio) that if you get hit backing in or out it is your fault.......some guy backed into my bro in late 2001 he was delivering pizza and following a guy the guy turned onto a road and then backed up.......that wasnt the raod he wanted and hit my bro and almost totaled the car........it was the other drivers fault.

Well it seems like a different scenario...was he on a open street and suddenly backed up? Well if thats the case thats the law everywhere.

It\'s your fault. And I think if the estimated damage is less that 500 bucks she is allowed to leave if you guys exchange info.

yeah i was afraid to realize that...but she\'s gonna get in trouble! after we both got out of the car i could only give my name and and number before she took off! She got scared.
Btw Vapor...she\'s ugly as hell! Unfornately i know her and i\'ll see her tomorrow. I\'m gonna kill her!:mad:

I wouldn\'t have turned down a new Honda Civic when I was in school, but damn, 99% of the people in the parking lot have been driving for 2 years or less. 80% of the people in the parking lot drive around like idiots because they don\'t care about the piece of crap with wheels their parents bought them. Not good odds.
I do hope you get it worked out. A lot of people around here skip insurance all together. Hey, it\'s Kansas.

Yeah, I wouldn\'t give my kid a brand new car. My neighbor has a duaghter and she got in numerous little fender benders her first couple years. It\'s just a car.
I had a real old SAABas a first car. I think it was a 1972. This was back in 1985. It rocked. No headliner. Got it out of a junk yard. I put a beer poster on the ceiling a long with a bunch of pictures of a friend of mine. He was in love with himself so we put them on the ceiling so he could sit back in the back seat and look at himself while getting road skull.
Those were the days.

Thats not always possible, I just got in an accident a month ago in a parking lot, I couldn\'t see out of either side since I had SUV\'s parked on both sides of me, so I slowly backed out and there was a car flying at me, they were definently speeding, I had to get out of their way so I backed up kinda fast, well I bumped the car behind me and the person flew by right in front of me, I would have got hit right in my driver side door so I basically was forced to wreck behind me so I wouldn\'t get hit

If she didn\'t give you her info, she fled the scene. File it with the police, then they will determine who\'s at fault. It\'s not always their fault if they hit you from the rear, but most of the time it is.

Leaving the scene won\'t get you into BIG trouble. My dad hit a car while backing up and left because he had to do something or else his job would be in jeopardy. Nothing happened to him after that. lol
It would be bad though if someone was hurt or something, but a minor fender bender, blah.

I\'m not 100% certain, but isn\'t any accident in a parking lot considered a "no-fault" situation? In a traffic accident, usually someone breaks the law and causes the accident. (failing to yeild the right-of-way, etc...)
That\'s what I remember from driver\'s ed in high school anyway...(10 years ago) ;)

Well i just finished talking with the police officer in school today with that ugly girl. Supposedly its my fault cuz that Right-of-way law.So i got pissed and told him the situation i was in, i had this stoopid Ford Exepedition on my right side and there was a car in front of me. So i backed up just a little bit so i could see if any car was coming or just to let a someone know i was trying to pull out.
Well i tell him that as i was backing, not even 2 ft later i felt my car shake and i heard this awful tearing of my rear bumper. She was so damn close to the cars in the parking lot going around 20mph. BTW she was driving a freakin tank!!! A 1978 oldsmobile...
Well i went to my stoopid insurance after that and I have to pay around $500 for my poor bumper and tail lamp, plus a deductable! I learned a valuable lesson these passed two days whenever you are in a parking lot trapped by huge vehicles just get out of the car and see if a car is coming.If someone is with you tell them to get out of the car and guide you out. :rolleyes:

In jersey, if you hit anyone in the back, even if they slam on their brakes for no damn reason, its your fault. She will get in some crap because she ran away but it is your fault too.
