Title: My car ...is gone..:(

I loaned my Honda Del Sol to my mother today (her car needs worked on) and I was workin\' anyways, so why would I need? Around 1:00 pm I get a call that she was drivin\' and a guy in a log truck on a country road was on the wrong side of the road and hit her head on. She\'s okay, but it messed up the front it pretty bad. The guy admitted it was his fault , and he wasn\'t suppose to even have a log truck on that road. Cop wrote it up as his fault also. Problem is, my insurance  had just expired and I was goin\' next week when I got paid to get it somewhere cheaper..

. His insurance said it wouldn\'t be a problem and that they\'d pay for it, because he admits it was his fault,etc. I\'m suppose to call for a rental car tommorw. I\'m just praying that I won\'t get screwed on this and they will indeed pay for my car, thus I won\'t have to pay for a car I can\'t even use.

God, I hate my life.

Yea..glad she is ok..and sorry about the misfortune. At least this time life may have stuck it in..but it didnt break it off. :)

I\'m really sorry to hear about this LIC!  How old was your Del Sol, and what was the value?  Hopefully the driver\'s insurance will give you full book value, and not some approximation of repair cost.  Perhaps you can upgrade now to something newer.

I\'m still selling my 95 Saturn SL1 if you\'re interested.  :)

It was a 95, low miles, perfect condition. Damn shame really. It was worth around $9,000 after it was paid off, etc. I\'m hoping to upgrade to something else. I don\'t know yet. Depends on how bad it is,etc. It looks pretty damn bad tho...*shrugs*

Cool that your mom\'s ok.. sucks that you\'re car isn\'t. The dude\'s insurance should pay out tho, but you never know. Depends on how much it is to repair. Last accident I really got in (not counting the 4 deer I killed in one collision.. w00t) I got screwed. The kid pulled out around me and tried to take a left before I could get moving. He ended up rolling completely over the front end of my GrandAM smashing up the whole drivers side. He parked his car a block up the road and got out admiting that it was his fault. When the cop got there he couldn\'t determine fault cause the kid moved his vehicle... even tho the bastard was admiting it.

Anyhow, turns out my insurance company wanted to place him at fault, but after getting a "late issue" police report they pinned it all on me which raised the cost of my insurance by 60 bucks a month. The kid ended up having an uncle who knew alot of the bigwigs in the Whitley County Court House and got a break cause of his family\'s connections.

Anyhow, since it was still drivable I told my insurance company to f*** off (they didn\'t wanna pay out) and dropped my policy. I jus used some foamy fill to put the headlight back in place and painted the yellow mass of crap grey to match the paint.

Glad your mother is ok though LIC. Hopefully the bastard/his assurance company will pay for a new car! You know, you should get them to buy you a S2000. ;)

Erm, actually it isn\'t really a funny story.. or have anything to do with mad skylz. I was jus driving along like normal and accidentally hit a pothole, which knocked my CD player onto the floor. (Yeah, it was portable.. not in-dash) So I\'m glancing up with one eye on the road with the other on the floorboard to find my player and everything seems fine. I take my eyes off the road for one second to reach over and pick it up and as soon as I look up there\'s a heard of about 10 of em all crossing the road together. I slammed on my brakes, but it was too late.. it was like going bowling.  

Kill 1 - Got it\'s ass end clipped by my headlight and spun it around 180 digrees. It didn\'t die right away, but layed in the road moaning until something nailed it. A truck I\'m assuming judging from the blood stains left on the road when I got back to the scene.

Kill 2 - Collapsed onto the hood and got scooped up and tossed over the drivers side of the car. I doubt it was the whole lenth of the car.. but he probly slid off my roof somewhere around the rear seat. He went over me.. I know that. This bastard caught the full force of the impact. I didn\'t get a close look at him afterward, but bouncing off the hood of anything going +20mph can\'t be healthy. Pretty sure all 4 of it\'s legs were broken, most of it\'s ribs, neck, back.. ect.

Kill 3 - Was pushed forward and down by the first deer and rolled up right under my tires.

Kill 4 - I dunno if he was actually killed.. and I don\'t know exactly how he got mangled.. but when it was over I saw him drag his furry ass up and limp his way off to the side of the road. I\'m jus assuming here that a broken leg and probable internal injuries is just a slow death.

Weapon of choice = 95\' Ford Taurus going roughly 50mph.

Well, I didn\'t go get it. My mother did, see\'ing as she wrecked my car, I made her go get it. Catch is, I can\'t drive the rental car! I\'m not 21. Bulllshittt...I\'m still screwed . On my days off I have no car. Sure, I have a ride to work now (we work at the same place, same crew, just different part of the factory - so we still never each other durin\' work.. I was doin\' overtime when I loaned it to her), but hell fire, I\'m still left without a car, for however long this takes .  
Damnit.

Don\'t let them fix it if you can,crashed cars seem to always have problems.And it does suck losing your first car..........until you get your new and better car.

Dont listen to him, just make sure you go o a good shop. Of the times I have wrecked or have been hit, the car was just as good as it was before.

Sometimes cars that should be wrecked end up getting fixed and thats where problems lie. Mainly with the frame or electrical problems b/c of a pinched wire that was never found.

Sorry man, but hey.. if you ever want someone to kill you I\'ll be glad to swing by in my Taurus. Bring along a sibling or girlfriend (preferably Ex) too if ya want. I\'m 4 - 0. :D

And by the way.. no.. the newer "better" car isn\'t always the most loved. I miss my 89 Grand Am and still have a bit of bitter resentment towards my Taurus for taking her place. There\'s just something about a piece of shyt car that makes me enjoy them jus a bit more than something newer or reliable. Maybe it\'s the trill of goin out and wondering if you\'re gonna make it home? They jus have so much more personality than a newer car.. it\'s almost like a woman. Gotta treat em jus right, jus the way they want to be treated, cause if you don\'t.. they get pissy and jus up an quit on ya.

Wow I have a lot of experience in these matters.  Though I am a Principle Transportation Planner now, when I first got out of college I wrote automotive insurance policies.  

First off glad your mother is OK.  

Now on to the topic at hand:

Your cars damage has to exceed apprx 60 percent of its value for an insurance company to total it.  Your lapse in coverage does not affect you since it was his fault - though you could get a ticket for having a lapse in most states.  

The most important issue regarding a claim is the company you are dealing with.  The major insurance carriers are usually pretty good ie. State Farm, USAA, Prudential, Hartford etc.   Watch out though if the company headquarters is in a strip mall - they will fight you every step of the way.

IF they repair your car you are entitled to diminished value.  This means that you are entitled to the difference between what the car was worth right before the accident and what it is worth after it is repaired.  The best way to do this is go to a Honda dealer and ask him what the car is worth and give him a copy of your repair list.  I was hit by some 16yr old girl last October and I was driving a 2001 Jetta GLX and received $1500 in diminished value alone.  Do not sign off on the claim until you get this!!!!!!  

Also don\'t sign off on the claim when your car comes out of the shop.  Drive it for a little while to make sure there are no leaks, electrical probs etc.  Insist on certified Honda parts.  Don\'t let them refurbish anything.

Bug the crap out of your claims representative.  If they are not wanting to pay for something keep on them, they will eventually give in.  My car was damaged *also* by the towing company when they put it on a flatbed.  Scratched the hell out of 1 of my 18 inch rims on the opposite side of where I was hit.  The towing company denied responsiblility so I threatened the claims rep with legal action.  A day later they paid for my rim.  

Pain and suffering is only viable if you have an injury that is noticable.  A broken bone, stitches, dismembered body part, whatever... if you have some mild whiplash you won\'t get much if anything at all.  Twenty years ago you could have gotten $15K for minor whiplash, today you hardly get a thing.

They called today and said they was most likely goin\' to total out the car. They then asked if my mother substained any injuries, which she did.

She has a concussion and went today for a catscan, to see if the swelling is still continuing. They put her on some meds to kill the headache. She also had a radical mesectimy (typo) a couple years ago, in the process they done surgery on one of her arms  and anytime it gets hit / cut it either swells up or gets infected. Well, when she got hit her arm went into the steering wheel, so now her arm is swollen up. She went on light duty at work,etc. Insurance company said  "we\'ll have to find a way to settle your injuries".

I got no clue what they plan on doin\', I just know they better hurry up. I want my car back or a new car. This rental car sucks. Damn family cars!

Heh try driving around in a Pontiac Bonneville for 5 months - I felt my hair greying.  Anyway, I think you still entitled to dimished value even if your car is totaled.  Also it sounds like your mother has more injuries than originally thought.  A basic rule is that the pain and suffering will be 2 to 3 times the medical bills for a legitimate injury.  Don\'t discuss any settlement regarding pain and suffering until your mother has completely healed.  Keep all doctors bills and prescription receipts also.
