Title: Law/Moral Question
Post by: Mr. Kennedy on June 10, 2003, 06:35:37 PM
Can you get in trouble, if you know of crime, and didn\'t try to stop someone from committing it?  If you try to hide your knowledge, and someone finds out, is that considered lying?

Possibly obstruction of justice. In some crimes, the mear(sp?) fact that you know makes you an accessory if the prosecution really wants to gun for you.

I don\'t think you are allowed to post more than one sentence in a hurricane thread.

In the UK you would most likely be charged with perverting the course of justice.

I study rights, so I should at least know a little bit about this (at least of the dutch law  ) , anyway, as stated above it\'s illegal to do so, but if you really don\'t want to tell the truth, you should tell (when asked of course) that you have no recollection of that certain event :D

If I tell someone I know what happened they\'ll nail my friend for sure and he won\'t be happy with me(he\'s only got a minor punishment at the moment because of doubts).  Then they\'ll ask why I didn\'t talk sooner, and i\'ll be screwed for life.

if its not then theirs no need to say anything, otherwise its better to spill the beans.

Its called perverting the cause of Justice (in Australia anyway)

You can go to jail if its a serious offence that your withholding information from.

Did someone get hurt or stole from? If so - you should be the moral person and come clean. If not, you are just as guilty, as you know about the crime.

As for your question - obstruction to justice and accesory depending on the crime. Either way, if you don\'t come clean and they find out the hard way, you\'re more likely to be arrested or what not. Best bet is to come clean to the cops and strike a deal.

if you didn\'t stop the crime because you were in a position of danger then I don\'t think theres a problem. If you didn\'t stop it because you thought it was funny at the time, or because you didnt think it would turn to crime then your an accessory.

what happened anyway?

We have had several cases here in tampa where people commited a crime and then shot themselves.  The widows of the perps are in jail because they didn\'t aid the police in the time of the investigation.

It doesnt matter if he comes clean. He can strike a good deal since he didnt commit said crime period. Our justice system favors the crook.

Here\'s the deal, my "distant" friend, I say that because I don\'t hang out with him, I know him kinda well, anyway, he hacked into computer systems and screwed up the entire system of Company A.  He\'s also been committing credit fraud, and got caught, but they can\'t give him a serious sentence because he\'s only been suspected and have no evidence or witness.  Now, he told me that he could do it, and showed me, but I don\'t want to say anything, because if I turn him in I don\'t want him messing with me you know.  I really don\'t want to be associated with a felon either.

You might get a reward for turning him in and if you do he can\'t go near a computer.  Is he bigger than you?  If not turn his wimpy ass in.

He showed you he "Could" do it.   HE didn\'t show you when he actually did it.

I don\'t think you\'d be required to turn him in if that were the case.  You would just be a witness in the trial saying he had the ability.  Not an eyewitness.

Well, actually, if he said he did it, and then showed you he could, then that\'s enough.  You should tell the truth, especially if they\'re already at the questioning you stage.  When you deal with the law, if you haven\'t broken a crime, you\'re 1000 times better off telling the truth, because if they catch you in even a small lie, you will be in bad straights.

Besides, if he\'s ripping off credit info from a company or people, then he\'s hurting a lot of people and deserves what he gets.

You need to evaluate what type of friendship you have with this person and what you have done for AND to each other in the past.

Make your decision from there.

I know if in your situation, I wouldnt turn in 85% of my friends. The other 15 would be up the creek without a paddle. :)

If the dude is going down and that is a certainty then bail.  Don\'t go down with the ship.  Fess up.
