Hmmm, that was mentioned a long time ago. I wouldve assumed MS would of handled the situation by now(ie:$$$$).

Microsoft could be forced to delay the launch of its long-awaited Xbox games console because of a trademark dispute with a small Florida-based company.
The leading software group is gearing up to launch the Xbox into a crowded market this autumn with a $500m publicity campaign.
But Xbox Technologies, a holding company with a stable of software businesses, insists it has first claim on the Xbox brand and says it is prepared to go to court to protect its trademark.
Any hold-up in the launch would be a huge embarrassment for Microsoft. The company has already recruited more than 150 developers to produce games for the Xbox - its first major hardware product which will compete with Sony\'s Playstation 2.
Xbox Technologies filed the first of its 47 current applications for the Xbox brand with the US Patent and Trademark Office back in March 1999. It plans to use it as an umbrella name for its software companies as well as a name for specific software products.
Microsoft filed its first application in October 1999. But John Van Leeuwen, chief executive of Xbox Technologies, said the first he knew about Microsoft\'s involvement was early in 2000 when he heard the news of Microsoft\'s ambitions in the games arena.
Mr van Leeuwen said he contacted Microsoft soon after, kicking off a round of negotiations that have yet to bear fruit.
"There\'s no way that we can co-exist," he said. "We can\'t afford to have our business confused with games for kids. Either we find a business solution or we get into a legal battle."
Mr Van Leeuwen said he had already offered to buy out Microsoft\'s claim on the name, but was rebuffed. He would not comment on whether he would be willing to sell his rights to the brand.
A Microsoft spokesman said he was aware of the situation but could not comment on ongoing negotiations. "We\'re certainly confident about what the outcome will be - we will prevail."
Jessie Marshall, a USPTO attorney said it was now up to one of the companies to back down, reach a settlement or fight for adjudication.
Microsoft could officially oppose Xbox Technologies\' prior claim and push for an adjudication from the USPTO\'s appeals board. "But once an opposition is instigated, it can take years to resolve," said Ms Marshall.
The USPTO said there was nothing to stop Microsoft releasing an Xbox-branded machine while the dispute was unresolved. But a product launch would leave Microsoft vulnerable to a legal challenge from Xbox Technologies which could ask the judge for an injunction, freezing the release.

I think you guys are forgetting whom we are talking about here, this is microsft, a multi-billion dollar corperation.
These guys "could" probably buy out the judges,lol,lol.
but seriously MS knew about this for well over a year and these guys are very confident of the outcome meaning, they are pretty much sure they will win, to which is the reason why they have risked it all by not changing the name.

something is not right..

could be , but maybe they tried to fork it out with MS, saying yeah we will give you our name, if you give us x amount of$$$$$$$$$$$$$$$$$$$$$$. If it does go to court, who do you think will win, legitimate or not

Its easy to see who wins,
if you own the rights to a name,
it don\'t matter if god wants that name, you own it
just beacuse MS wants that name and MS is a big company, does not mean a court is going to give it over in a case.

I think it was stupid of MS not to sort this out already... if XB is delayed, it\'s gonna be behind... maybe too far behind. Sony was lucky last time, will they be lucky this time? I wait and watch in interest... like a car wreck... :D

If you actually think this will slow down MS your even more dumb than you thought. Ms is a multi-multi-multi-billion dollar company. This will not slow them down and than could simply call it x-box if they want too and that would solve it.

Yet. This company that has Billions of dollers. Arn\'t even smart enough too check if there XBOX brandname was already taken. MS seem just to do what they want and think they can get away with it.. Some how i doubt that.

this wont slow ms down!, but it seems strange that ms has already handeled the situation. It\'ll be solved by the time xbox launches.
but if ms decides to delay it in the us, its gonna be snes megadrive war al over again!!!. Ms already delayed in Europe, so a second delay would be a big blow to the xbox userbase set up

they are not releasing the x box untill next year in the UK , but the US and Asia will have it first ?

They will do what they want. If it comes down to it they will say here, here is $500 million, shut up and take the money..
Guess what, he is gonna take the money... Simple as that. The person with the most money wins, and MS has the most money. They will either buy him out or the courts. Very simple.

Even if Gates gets in trouble and sweeps the streets for a living, wich will never happen because if he does get in trouble he can bribe the police like the mafia does.But if he does, somehow have to do that he wont have to sweep because with the money he has he dont need anymore money.But hopefully for Sony\'s benifet that will happen then sony will win the game console war! :D :D :D :D :D :D

I\'m not trying to start a war here, but this Microsoft bashing has me confused. Why does this hatred exist for Microsoft among certain groups? I think it\'s kind of scary to see the the feds go after a company because they believe it\'s getting too big. Do you really believe that Bill Bates is evil incarnate for creating a product that is very popular? I know I\'m all over the map here but I need to know.
Also, why would you anybody be happy to see the XBox delayed. I for one can\'t wait to get my hands on the system.

Ace-Theyre all cry babies, thats why. You\'d think MS or Gates\' did something to them personally by the way they whine. They\'re like fake enviromentalists who just jumped on the bandwagon in the 90\'s. They dont really care about MS (although everyone has a opinion of Gates), its just popular to bash MS, and the losers think it makes them cooler to copy the other fewer senior members who actually dislike MS. They\'re posers.

There won\'t be a delay. As far as I can tell, the case won\'t hold up in court. The Xbox console has nothing to do with XBOX Technologies as they are dealing with 2 totally distinct markets. It\'s like if someone were to open up a Mcdonald\'s Hardware shop, they couldn\'t be sued by Mcdonald\'s restaurant.
