A case now before the U.S. Supreme Court provides an opportunity to move our country in the direction of the genuinely color-blind society - a goal long sought by men and women of good will.

The case is being brought by white firefighters in New Haven who were denied promotions after an examination yielded no black firefighters who were eligible for advancement. The city decided to throw out the test, calling its action "racially neutral."

In the case of* Ricci v. DeStefano*, 19 white firefighters and one Hispanic say they should have been promoted based on their successful scores. The city argued that certifying the tests would have left it vulnerable to lawsuits for violating Title VII of the Civil Rights Act if the white firemen were promoted.

Yeah this is pretty lame. Test scores in school don\'t get thrown out if the black students happen to fail. Test scores should be effective regardless of race, and that\'s where we should be. These laws are in place to keep people from intentionally holding back whatever minorities, but the rules should be to make the opportunities for advancement available to everyone equally. It\'s probably harder to enforce that way? So we were lazy about implementing these new laws and now people think there are racial quotas to fill. Worse, they might be right.

Here in Tampa it is extremely tough to get hired onto the fire department as a white firefighter.  I have two buddies who both ended up in the top of their respective classes get completely passed over while people they knew from school (happened to be black) have been hired.

That is usually how it happens unfortunately.

Im all for people getting hired/promoted on merit.

Problem with that is often those with qualifications get fucked over one way or another.

Hell, look at the gay AF Lt. Colonel Victor Fehrenbach.

Guy was discharged despite the fact he has 18 years service, 400 combat hours....flew 88 missions...9 air medals...handpicked to patrol DC during Obamas inauguration.

Yea, doesn\'t really have much to do with this particular issue, but civil rights in general.

Those guys should\'ve been promoted no questions asked. If they passed the test, they deserve to move forward...those black folks just need to study harder. I\'m against racial discrmination, but this is bulls**t. I took the fireman\'s test for east orange,nj years ago.....i passed with a C+, and even tho it was a passing grade, the powers that be stated that they wanted folks to get at least a B+ or better.

They gave me a date when i could re-take the test, but i didn\'t, since shortly after that i got promoted on my then current job. It\'s not like it\'s over for these cats that failed the test, they can always re-take it....no need for them to be acting like whiny cowards.....man-up, study harder and re-take the test....simple.

This is essentially a case of eliminating discrimation against blacks by replacing it with discrimination against whites, heh. Oops.
