Don\'t let them fix it if you can,crashed cars seem to always have problems.And it does suck losing your first car..........until you get your new and better car.

Dont listen to him, just make sure you go o a good shop. Of the times I have wrecked or have been hit, the car was just as good as it was before.

Sometimes cars that should be wrecked end up getting fixed and thats where problems lie. Mainly with the frame or electrical problems b/c of a pinched wire that was never found.

And by the way.. no.. the newer "better" car isn\'t always the most loved. I miss my 89 Grand Am and still have a bit of bitter resentment towards my Taurus for taking her place. There\'s just something about a piece of shyt car that makes me enjoy them jus a bit more than something newer or reliable. Maybe it\'s the trill of goin out and wondering if you\'re gonna make it home? They jus have so much more personality than a newer car.. it\'s almost like a woman. Gotta treat em jus right, jus the way they want to be treated, cause if you don\'t.. they get pissy and jus up an quit on ya.

Wow I have a lot of experience in these matters.  Though I am a Principle Transportation Planner now, when I first got out of college I wrote automotive insurance policies.  

First off glad your mother is OK.  

Now on to the topic at hand:

Your cars damage has to exceed apprx 60 percent of its value for an insurance company to total it.  Your lapse in coverage does not affect you since it was his fault - though you could get a ticket for having a lapse in most states.  

The most important issue regarding a claim is the company you are dealing with.  The major insurance carriers are usually pretty good ie. State Farm, USAA, Prudential, Hartford etc.   Watch out though if the company headquarters is in a strip mall - they will fight you every step of the way.

IF they repair your car you are entitled to diminished value.  This means that you are entitled to the difference between what the car was worth right before the accident and what it is worth after it is repaired.  The best way to do this is go to a Honda dealer and ask him what the car is worth and give him a copy of your repair list.  I was hit by some 16yr old girl last October and I was driving a 2001 Jetta GLX and received $1500 in diminished value alone.  Do not sign off on the claim until you get this!!!!!!  

Also don\'t sign off on the claim when your car comes out of the shop.  Drive it for a little while to make sure there are no leaks, electrical probs etc.  Insist on certified Honda parts.  Don\'t let them refurbish anything.

Bug the crap out of your claims representative.  If they are not wanting to pay for something keep on them, they will eventually give in.  My car was damaged *also* by the towing company when they put it on a flatbed.  Scratched the hell out of 1 of my 18 inch rims on the opposite side of where I was hit.  The towing company denied responsiblility so I threatened the claims rep with legal action.  A day later they paid for my rim.  

Pain and suffering is only viable if you have an injury that is noticable.  A broken bone, stitches, dismembered body part, whatever... if you have some mild whiplash you won\'t get much if anything at all.  Twenty years ago you could have gotten $15K for minor whiplash, today you hardly get a thing.

They called today and said they was most likely goin\' to total out the car. They then asked if my mother substained any injuries, which she did.

She has a concussion and went today for a catscan, to see if the swelling is still continuing. They put her on some meds to kill the headache. She also had a radical mesectimy (typo) a couple years ago, in the process they done surgery on one of her arms  and anytime it gets hit / cut it either swells up or gets infected. Well, when she got hit her arm went into the steering wheel, so now her arm is swollen up. She went on light duty at work,etc. Insurance company said  "we\'ll have to find a way to settle your injuries".

I got no clue what they plan on doin\', I just know they better hurry up. I want my car back or a new car. This rental car sucks. Damn family cars!

Heh try driving around in a Pontiac Bonneville for 5 months - I felt my hair greying.  Anyway, I think you still entitled to dimished value even if your car is totaled.  Also it sounds like your mother has more injuries than originally thought.  A basic rule is that the pain and suffering will be 2 to 3 times the medical bills for a legitimate injury.  Don\'t discuss any settlement regarding pain and suffering until your mother has completely healed.  Keep all doctors bills and prescription receipts also.
